Thanks to Max for introductions to trust law and for pointing me/us to Dean's work... You both have truly given me the tools that i have been looking for because i have known for a while now that i am a free Man.
I'll try and keep this 'short', and would appreciate any input from members of the forum
(The following occurred in Brisbane, Australia)
One fine afternoon (before learning about trust law etc..), after deciding to give up supplying green leaf material, and give my life a radical renovation, I was greeted by three detectives just after leaving out the back door of my apartment. They wanted to know my name, so i had them identify themselves and replied that my name was "private information". They continued to inquire and my answer stayed the same, and i eventually said, i will identify myself if i can make a phone call to get some legal advice. They denied me this told me that they were only going to ask me for my name one more time and that they had a warrant to search my bedroom and house, and that we should go inside (the open door just near us to was to my bedroom), sit down and talk about it. I felt quit intimidated and followed one detective into my room, while the other two follow in behind (which I learnt during a security course a few years ago may be considered as being detained or under arrest). I sat in my office chair, one of the officers stood to my left and the other two sat in front of my on my bed (essentially blocking all exits to the room). I again said that i wanted to make a phone call, and they said they would only ask my for my name once more, and if i didn't comply, they could charge me with a criminal offense... I could not think very straight at the time and didn't know what course of action to take... so i caved.
After identifying myself they let me make a phone call, to my uncle who has had some experience with dealing in civil cases as a free man.
I tried to keep quiet throughout the execution of the warrant, but made a couple of admissions etc... Went back to the cop shop voluntarily, where i was arrested and put in a cell for and hour or so while they did some paper work. I declined an interview. Signed my papers with my signature followed by Under Duress.
I moved house, asap and got a call a week later that they wanted to see me so they could charge me with some more stuff that they got evidence from off my mobile phone. After some fantastic advice from my uncle and some bad advice from a long time drug user uncle, i went with the bad advice and gave an interview where i made way too many admissions on recording etc... which they then used to add another charge... took my papers and left.
So two months later i go to court facing 7 charges including possession, supply, implements for use, property used in commission, property suspected to be proceeds, possession of a controlled substance (which their lab identified as Diethyltryptamine (spelling mistake or faulty equiptment or inferior product? who knows), got an adjournment (because the police lodged the QP-9 facts and evidence sheet the day before my hearing), a month after that i got another adjournment because legal aid had not yet responded to my application...
Now it is Thursday 6th october, i have court on the 12th and legal aid is expecting a call from me so we can talk about my case (they ignored my request for my preferred lawyer).
I am fairly certain i can prove that i was unlawfully arrested before i had identified myself, and show that the "police" are lying as to the 'facts' of the event... But why would i want to when I a the administrator of my account right?
I have completely changed my life, moved away from the city to the sunshine coast, done some thorough detoxing, live a sober, natural, Raw and Living Whole Foods lifestyle and give guidance/advice in holistic health whilst selling organic bananas and studying nutrition & shiatsu massage.
So i am going to send off my papers on monday to the Attorney General so i can get the ball rolling on the default judgment regarding my position of administrator/sole share holder/beneficiary of my account, and the fact that i do not have a contract with the CROWN and i am not a public servant, nor was i acting in that capacity at the time of complain or arrest, ask for provision of proof of claim etc... I've been taking notes when watching Dean Cliffords vid's and am confident i can put it together correctly, particularly after i spend this weekend rewatching some of them and solidifying my stance within myself.
I am wondering a couple of things...
1. I am out on extended bail (signed an undertakings as to bail form), and wonder if/how this could affect my situation.
2. Thoughts on what could happen regarding my interview/many admissions that i contractually agreed to give an certified verbally. (so, how do i null a void all contracts previously made? do it in my letter to Attorney General?)
3. Thoughts on ways to get more time to ensure that my affidavit etc is ready to lodge so i can have these charges dismissed. (Say i need more time for legal advice because my legal aid application was only approved last week? Say i am waiting on a reply to from the crown/prosecution to clear up some misunderstandings so that we can proceed? Or just go ahead and break the presumption, ensuring that all parties know their roles, and stand in my power and dealing with it on the 12th of October or... Not show up to court and have a warrant issued for my arrest whilst i arrange my paperwork and set a fee schedule - still need to learn how to properly enact/create this -)
I would love for every one to offer their thoughts/advice/reminders/cautions about my situation and any personal experience that might give some insight or just be an interesting read...
