Hello, all. I'm from New Jersey, USA. About a month ago I was arrested for not giving my driver's license, name, or any information regarding my person to a cop on the side of the road. I told him I respectfully decline to give him any information as I hadn't caused any harm. He told me to get out of the car which I did. (I realize now I should've informed him of a fee-schedule at the time, but I hadn't read about Dean Clifford's stuff yet.) Well, I got out of the car and he asks me for my name and ID again. I told him the same crap as before. So he starts searching me and I tell him he does not have my consent. He says, "I don't need your consent." Which I assured him he did as I hadn't harmed anyone and he was out of jurisdiction. Then he tells me to face the hood of my car which I do. He starts arresting me and I tell him I haven't done anything wrong, there are no charges against me, no harm, and you don't even know who you're arresting. So I fidget my arms to make it a hassle for him to put the cuffs on, he says he's going to mace me if I keep it up. I keep it up. He then uses all his power over me to twist my arm and throw my entire body onto the hood of my car which hurt like hell. I was immobilized from his force. Completely under duress.

Long story short, I get to the police station where they ask me for my fingerprints and mugshot to which I said I do not consent. The head-cop comes in and sees that I will not comply and tells the cop who arrested me to "just use the handheld camera on him" The cop picks it up and attempts to take a picture of me, "NO CONSENT! NO CONSENT!" and I put my shirt over my head.

While all of this is going on, they had sent cops to my parents home to find out who I was. They had given them my information which is hearsay. I never gave my name verbally. They did however force me into fingerprinting.

I'm thrown into the jailcell for the night through the next afternoon, no food. No toilet paper. They then send me in-front of a judge or magistrate a few towns over, I'm not sure which one. It was very impromptu. The judge lowered my bail from 7,500$ to 335$. Which was a relief at the time. Then I was sent to the county corrections facility for 2 days as I attempted to make bail.

I've been reading Dean's stuff as of late and have sent them this document.

Ten days have gone by and no response, as expected. So yesterday I sent the notice of default.

Sorry for the long post. I'm not sure what steps to take next. I like what Derek Hill has done with cashing in his tickets.
I have about 7 tickets. (Obstruction of law, obstruction of justice, resisting arrest, driving while suspended, improper parking, parking near cross-walk, and having a warrant) all of which are complete bullshit as we all know. No harm done! Do no harm!
I'd like to cash those in of course, though I'm not sure how. Either way, I'd like all these charges to be dismissed.

I'm going for this administrative remedy and exhausting it all before I can move onto the next step. The thing is, this is the US where things are a bit different so I'm not sure about my next step. I was thinking about calling up the court in about a week and asking if they have received my documents and if they've been filed. If they have, good, If I ever go to court again I will have my case already won through the paper work (as per Dean's style of doing things.) If not, then what?

All in all, I'd just like some feedback (from Dean preferably as I see he's here once in a while and I am very confident and understanding of his tactics) on my documents and some sort of light to guide me in this tunnel.

Thanks very much, everyone. Keep on truckin'!

Well, I've just gotten an "OFFICIAL LEGAL NOTICE" in the mail informing me my court date has been rescheduled to the 25th.

I called up the court admin. on Friday asking if the court had received my documents and she said they hadn't. She also informed me about the reschedule. They're still pestering me with this legal notice and my fee-schedule has been sent over and is in place yet they act as if they've never received my stuffs. I sent it through certified mail and they def. got it according to the tracking number.

Hi Matt
Great work, call them again & say I have proof here that the Courts have received my documentation can you confirm it is on file, if it is not on file then I need to speak to a highest authority to explain why the court has failed in its duty to to follow the correct procedure in the filing of said legal documentation & an explanation of what they are going to do to rectify there failure, with conformation in writing

Hey guys, the courts just sent me 5 notices for each violation to appear in court on 10/25/11. Letting me know if I wish to plead not guilty that I must notify the court at least 7 days prior to that date. Blah blah blah, may be a warrant for my arrest if I don't.

Last week they sent me a general notice of this crap. Now they sent me 5 more for each violation on the same day BUT the date has been changed from 9:02am to 5:12am. LOL

I sent them a letter in between these notices:

These 5 new notices are now in breach of the terms of my fee-schedule. I let them off the hook the first time due to what I had assumed to be an error on their part, but they still insist. I must take action against them at this point. It's extremely vexatious to my family and I.

Any pointers on how I should go about suing them or exhaust anymore possible administrative remedies?

Hi Matt
Not sure if this will help as its for the UK, over here you need an N1 form, I guess your forms will be similar, help with filling them out in the link

Great! It's good to have this info. I'm going to call the court clerk today and see what's up with my case and why they (most likely) have ignored my documents. I will follow what you told me a few posts ago. I will also let them know I will be contacting the Government Records Council (GRC) since they failed to file the stuffs into the public record. They should handle it appropriately.

I'll bring up their failure to allow me due process and mention that I will contact the Attorney General. A bit of a scare tactic for now, but I will contact both of them if need be.

I found these two other administrative remedies and I will follow through with these and more until my case is dismissed.

I figured I should exhaust as much as I can before I file a claim against them. What do you think of this route, Deacus?

Thanks, man!

I just got off the phone with these knuckleheads. They have NO CLUE what an administrator is "You mean you're representing MR. VIOLA?" NO, I'm the god damned legally appointed admin of MATTHEW VIOLA!

Anyway, I got transfered to 3 different court clerks. They all said I cannot get a case dismissed through the mail and that I would have to show up in person. I informed then that I would not being showing up as the matter had been settled. If they looked at my documents they would see this. After a few back and forths of inquiring if my documents had gone on record I FINALLY got a confirmation that they were in fact there and on the public record.

I mentioned there is a motion to dismiss in my documents as the case had been settled thanks to default judgment. She said, "I see no type of motion to dismiss here that looks like something I could present to a judge, and you must do that yourself, on your feet, in front of a judge." Dealing with these folk are like dealing with a brick wall.

Now it seems they blatantly don't care/know/understand anything of what I'm doing. The ignorance of the law here in NJ is astounding to say the least.

I don't know what do now. I'll most definitely sound out more documents, maybe to the attorney general, prosecutor himself...
